Court rejects advocates seeking earlier drug access

A Washington, D.C., court has ruled that incurable patients cannot access experimental drugs after phase I clinical trials. The 8-2 ruling by the full U.S. Court of Appeals for the District of Columbia reversed a May 2006 ruling by a divided three-judge appeals panel, which overturned a 2004 district court decision to throw out the case. The AAMC and other organizations filed amicus briefs in the case supporting the U.S. Food and Drug Administration's clinical trials process.
